WHAT IS THE SCOPE OF THIS PRIVACY POLICY?

This Privacy Policy (“Policy”) is incorporated into the Blue Fever Terms of Service, and applies to information obtained by us when you sign up for, use, access or otherwise interact with any Blue Fever websites, products, services and anywhere else where this Policy is posted (collectively, the “Services”). This Policy applies regardless of whether you access the Services using a personal computer, mobile device, or other equipment or device.  If you disagree with the terms of this Policy, please do not use the Services.  

WILL THIS POLICY EVER CHANGE?

We may change this Policy from time to time.  If we make changes, we will notify you by posting the updated policy and revising the “Effective Date” above.  Use of the Services after the posted Effective Date means you accept the current version of the Policy, including any changes made prior to the posted Effective Date. If we make any material changes to this Policy, we will also notify you by email to your registered email address, by notice posted on the Services or through other appropriate communication channels. We encourage you to review the Policy whenever you use our Services to stay informed about our information practices and the choices available to you. All changes shall be effective from the date of publication unless otherwise provided.

WHAT INFORMATION IS COLLECTED FROM/ABOUT ME?

We collect personal information you provide to us in a variety of ways.  For example, you may provide us your personal information when you place an order, register for an account, make an online purchase, post a review, send us messages, subscribe to our mailing lists, newsletters or other forms of marketing communications, participate in a survey, contest or sweepstakes, redeem a promotion, or use some other feature of our Services.  Sometimes we collect personal information automatically when you interact with our services and sometimes we collect the personal information directly from you.  At times, we may collect personal information about you from other sources and third parties, even before our first direct interaction.  

Information You Provide:

We collect the following information you provide in connection with our Service:

  • Account and Profile Information.   We collect personal information, such as your name, email address, phone number, avatar, user name, date of birth, profile photo, and any information you provide in your bio when you register for our Services; connect with a Big Sister; sign up for our mailing list; complete your profile; or otherwise communicate or interact with us. We use this information to create, verify, and personalize your account, to fulfill your request or transaction, to communicate with you directly, and to send you marketing communications in accordance with your preferences. 

  • Communications, Comments and Opinions.  We collect any information that you submit in any postings, chats, comments or forums within the Services and, if you send an e-mail to us, we will collect your email address and the full content of your email, including attached files and other information you choose to provide to us. When you contact us directly (e.g., by email, phone, mail or by completing an online form or participating in online chat) or connect with a Big Sister, we may record your communications, comments and opinions.  We may also record comments and opinions you express when responding to surveys, entering a sweepstakes or taking part in a promotion.  We may use this information to respond to your question or comment, to provide you the Services, to evaluate and improve our products and services and to inform our marketing and advertising activities. 

We use this information to operate, maintain, and provide to you the features and functionality of the services, as well as to communicate directly with you, such as to send you email messages.   We may also send you service-related emails or messages (e.g., user account verification, change or updates to features of the services, technical and security notices) and communications from or about Blue Fever.  

Information Automatically Collected When You Use Our Services:

Like most digital platforms, we collect certain personal information automatically when you visit and use our Services, including:

  • Information You May Post or Submit on the Services.   We collect information about how you use the Services, your actions on the Services, and content you post to the Services, including the groups you belong to, your actions and interactions with others on the Services, and photos and videos you post to the Services or send through in-app messages or other functionalities (“User Content”). To share photos and video, we will access your device camera roll and camera with your permission. If you need to update your permissions, you can do so in the “Settings” app of your device. Please remember that we may, but have no obligation to, monitor, record, and store User Content in order to protect your safety or the safety of other users, to assist with regulatory or law enforcement efforts, or to protect and defend our rights and property. You consent to the recording, storage and disclosure of such communications you send or receive for these purposes.

  • Information from Third-Party Sites/Social Networks You Connect to Our Services.  We may receive personal information about you from third parties and combine that with information we collect through our Services. For example, we may obtain information when you log in through a third-party social network or authentication service, such as Facebook, Instagram or Google.  These services will authenticate your identity and provide you the option to share certain personal information with us, which could include your name, email address, address book and contacts, or other information.  Similarly, when you interact with us through a social media site or third-party service, such as when you like, follow, or share our content on Facebook, Twitter, Pinterest, Instagram, or other sites, we may receive information from the social network, including your profile information, picture, user ID associated with your social media account, and any other information you permit the social network to share with third parties. The data we receive from these third-party sites is dependent upon that third party’s policies and your privacy settings on that third-party site.  You should always review and, if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to our Services.  

  • Contact List Information.  With your permission, we may access your contact list available on your mobile device so that you can invite your friends and contacts to connect with our Services. We will store these contacts for purposes of alerting you when your contacts join the Services at a later time so that you may connect with them on the Services, and to suggest friends and connections to other members.  We may also use the information collected from your contact list and your friends' contact lists to suggest new friends you may want to connect with on the Services.  We make these recommendations based on your contact list information as well as your friends' contact list information and try to find common friendships or connections to introduce you to.

  • Usage and Device Information.  To provide a personalized and high-quality experience for our users, we, and our third-party partners, may use various technologies that automatically record certain technical information from your browser or device when you visit our website, read our e-mails, use our Services, or otherwise engage with us.  This information is typically collected through a variety of tracking technologies, including cookies, web beacons, embedded scripts, location-identifying technologies, file information, and similar technology (collectively, “Tracking Technologies”).  We, and our third-party partners, use these Tracking Technologies to automatically collect usage and device information, such as:

  • Your IP address, browser type, Internet service provider, platform type, device type, operating system, date and time stamp, a unique ID that allows us to uniquely identify your browser, mobile device or your account, and other such information.  

  • We also collect information about the way you use our Services, for example, the site from which you came and the site to which you are going when you leave our website, the pages you visit, the links you click, how frequently you access the Services, whether you open e-mails or click the links contained in e-mails, whether you access the Services from multiple devices, and other actions you take on the Services.  

  • When you access our Services from a mobile device, we may collect unique identification numbers associated with your device (including, for example, a UDID, Unique ID for Advertisers (“IDFA”), Google AdID, or Windows Advertising ID), mobile carrier, device type, model and manufacturer, mobile device operating system brand and model, phone number and, depending on your mobile device settings, your geographical location data, including GPS coordinates (e.g., latitude and/or longitude) or similar information regarding the location of your mobile device, or we may be able to approximate a device’s location by analyzing other information, like an IP address.

We may also work with third-party partners to employ technologies, including the application of statistical modeling tools, which permit us to recognize and contact you across multiple devices.  

Do Not Track Signals.  Although we do our best to honor the privacy preferences of our users, we are unable to respond to Do Not Track signals set by your browser at this time.  

If you would prefer not to accept cookies, most browsers will allow you to (i) change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; (ii)  disable existing cookies; or (iii) set your browser to automatically reject cookies.  

Please note that not accepting cookies may negatively impact your experience using the Services, as some features and services on our Services may not work properly.  Depending on your mobile device and operating system, you may not be able to delete or block all cookies and you may not be able to block non-cookie technologies and these browser settings that block cookies may have no effect on such techniques.  You may also set your e-mail options to prevent the automatic downloading of images that may contain technologies that would allow us to know whether you have accessed our e-mail and performed certain functions with it.  We and our third-party partners may also use cookies and tracking technologies for advertising purposes.  For more information about tracking technologies, please see “Third-Party Tracking and Online Advertising” below.

Information from Other Sources and Third Parties

We also obtain personal information from other sources, which we often combine with personal information we collect either automatically or directly from you.  We receive the same categories of personal information as described above from the following sources and third parties:

  • Social Networks Through Your Interactions When you interact with our services through various social media networks, such as when you “Like” us on Facebook or when you follow us or share our content on Facebook, Twitter, Snapchat, LinkedIn, Instagram or other social networks, we may receive some information about you that you permit the social network to share with third parties.  The data we receive is dependent upon your privacy settings with the social network.  You should always review and, if necessary, adjust your privacy settings on third-party websites and social media networks.

  • Information Provided by Others  From time to time, we may receive information about you from third parties and other users.  For example, we may obtain information from our marketing partners or from third parties to enhance or supplement our existing user information.  We may also collect information about you that is publicly available.  We may combine this information with the information we collect from you directly.

HOW IS MY INFORMATION USED?

We use your information for purposes described in this Policy or as otherwise disclosed to you on our Services or in connection with our Services.  For example, we use your information to: 

  • To fulfill your requests and provide the Services to you.  For example, we may use your information to complete your order or other online request or transactions, or respond to your customer service requests or feedback.  We may also use your information to personalize your experience with us.

  • To monitor, improve and develop our products and services.  We may use your information to understand our visitors and users and tailor our product offerings accordingly.  From time to time, we analyze statistics and trends to make our Services better and to develop new services or features.

To protect the security and integrity of our business, comply with legal requirements and obligations, or as otherwise permitted by law.  We may use information to protect our company, our affiliates, our customers, our franchisees and our websites.  We may also use information in order to comply with laws, regulations, court orders, or other legal obligations or to assist in an investigation to protect and defend our rights and property, or the rights or safety of third parties, to enforce our Terms of Service https://www.bluefever.com/terms, this Policy, or agreements with third parties, to detect and prevent fraud or for crime-prevention purposes, or for any other reason permitted by law.

We may use aggregated and/or de-identified data or other data that is not personally identifiable for any purpose, including without limitation in statistical analysis to help us analyze patterns in the use of the Services.

By accessing and using the Services, you consent to our use of your information about you in the manner described in this Policy.  If you do not agree or do not consent to the use of your information in these ways, you should not use the Services.

WHEN IS MY INFORMATION DISCLOSED?

By accessing and using the Services, you consent to us sharing your information under the circumstances described in this Policy.  We may share your personal information in the instances described below.   

Remember, our Services allow you to connect and interact with others. As described below, your username and avatar and any User Content that you post to the Services will be visible to other members of the Services by default when you create a profile, interact with others on the Services in public groups, and post information or User Content to public spaces. Please do not provide personal information in your User Content that you would not want to be public and/or visible to others. Please visit your Settings page to adjust your visibility preferences.

  • Other #moodcamp and Blue Fever app Users.  Some of your profile information (avatar and user name) and User Content you post to public areas of the Services, including public groups, will be visible by other users on the Services and the public. You can control the visibility of some of your information and actions on the Settings page or in your post permissions before posting. For more information, see “Control Over Your Information” below.

  • #moodcamp and Blue Fever app Users with Whom You Communicate on the Services. We share your information and User Content with third parties with whom you communicate on the Services, for example through comments, direct messages and chats.  You control who you want to communicate with and what information you share. Sharing information with others on the Services is done at your own risk.

  • Promotional Partners.  We may share limited information with third parties with whom we partner to provide contests and sweepstakes, or other joint promotional activities.  These partners will usually be clearly identified in the contest rules or promotional materials.

  • Online Advertising Partners.  We also share personal information with advertising networks or permit these partners to collect information from you directly on our websites to facilitate online advertising, such as search engines and social network advertising providers to serve targeted ads to you or to groups of other users who share similar traits, such as likely commercial interests and demographics, on third-party platforms.  For more information, including how to opt out of interest-based advertising, please see “Third-Party Tracking and Online Advertising” below.  

  • The Public.  When you provide feedback or post user content on our services (e.g., if you post a product review on our website or comment on our social media sites), your information (e.g., your username and comments) may be displayed on our websites or on our social media pages.  When you engage with us on social media, we may tag your social media account or the social media account of others (e.g., to give photo credit to another user).  

  • Within Blue Fever. We may disclose personal information between and among our parent company, Blue Fever Inc. and its current and future affiliates, subsidiaries, and other companies under common control or ownership.  These Blue Fever Inc. entities disclose personal information to other Blue Fever Inc. entities for purposes and uses that are consistent with this Policy.  

  • Information Shared at Your Request Through Third Party Social Buttons, Widgets and Other Embedded Content. Some of our Services carry embedded content controlled by third parties for services such as social sharing, commenting and displaying video or images.  When you interact with these services they may collect information from and about you and your interaction with their content, including the URL of the web page you are visiting.  This activity will be subject to the privacy policy of and your settings for the third party network or service.  Please be aware that they may track your activity, including through the use of cookies or similar technology, without you needing to interact with them.  If this concerns you, ensure you log out of their services before using ours.   

  • Third Parties at Your Request.  For example, you may have the option to share your activities on the Services with your friends through email, text, or on various social media sites.

  • Service Providers.  We share personal information with third-party vendors, consultants and other service providers who perform functions or services on our behalf and under our instructions to make our services available to you.  For example, this may include vendors and providers who engage in marketing or advertising activities or provide mailing or email services, tax and accounting services, auditing and compliance, fraud prevention, infrastructure provisioning, analytics services, IT services, product fulfillment, and web hosting. We may share your information with such service providers subject to confidentiality obligations consistent with this Policy and on the condition that the third parties use your information only on our behalf and pursuant to our instructions.

    • to protect the health and safety of us, our customers, or any person; or

  • With Your Consent or At Your Direction.  We may share information about you with third parties whenever you ask, consent to, authorize, or direct such sharing.

We may also share information with others in an aggregated or otherwise anonymized form that does not reasonably identify you directly as an individual.  This Policy does not limit our use or disclosure of aggregated or otherwise anonymized (i.e., information from which your name and any other personally identifying information has been removed) in any way, and we reserve the right to use and disclose such information to our partners, advertisers and any other third parties at our discretion.  

If you do not agree or do not consent to the disclosure of your information in any manner described above, you should not use the Services. 

YOUR CHOICES AND CONTROL OVER YOUR INFORMATION.

Profile and data sharing settings.  You may update your profile information, such as your user name and profile photo, and may change some of your visibility sharing preferences by visiting the Settings page emailing us at info@bluefever.com.  

Access to your device information.  You may control the app’s access to your device information through your “Settings” app on your device.  For instance, you can withdraw permission for the app to access your camera roll, microphone and camera.  

How to control your communications preferences.  You can stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in such communications or by contacting us directly at info@bluefever.com.  We make every effort to promptly process all unsubscribe requests.  Despite your indicated e-mail marketing preferences, we may still send you relationship and/or transactional e-mails regarding the Services, including, for example, administrative confirmations and notices of updates to our Policy, if we choose to provide such notices to you in this manner.

Modifying or deleting your information.  If you have any questions about modifying your information, or if you want to remove your name or comments from our Services or publicly displayed content, you can contact us directly at info@bluefever.com.  We may not be able to modify your information in all circumstances.  

THIRD-PARTY TRACKING AND ONLINE ADVERTISING.

We participate in interest-based advertising and use third-party advertising companies to serve you targeted advertisements based on your online browsing history and your interests.  We permit third-party online advertising networks, social media companies, and other third-party services to collect information about your use of our Services over time so that they may play or display ads on our Services, on other websites, apps, or services you may use, and on other devices you may use.  Typically, though not always, the information used for interest-based advertising is collected through cookies or similar tracking technologies.  We may share a common account identifier (such as an email address or user ID) or hashed data with our third-party advertising partners to help identify you across devices.  We and our third-party partners use this information to make the advertisements you see online more relevant to your interests, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research.

HOW LONG DO YOU KEEP MY INFORMATION?

We will hold your personal information on our systems for as long as necessary to provide the relevant Services to you or for so as long as reasonably required to satisfy the purpose for which you submitted the information.

CHILDREN’S PRIVACY.

Our websites and online services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 13.  If you are under the age of 13, please do not use our websites or online services or otherwise provide us with any personal information either directly or by other means.  If a child under the age of 13 has provided personal information to us, we encourage the child’s parent or guardian to contact us at info@bluefever.com to request that we remove the personal information from our systems.  If we learn that any personal information we collect has been provided by a child under the age of 13, we will promptly delete that personal information.  

WHAT ABOUT LINKS TO THIRD PARTY WEBSITES?

Links to third party websites may be made available through the Services. Clicking on such advertisements and links will direct you to the website or application of a third party. We are not responsible for the privacy practices or the content of such websites. Any information you provide via those sites is subject to the privacy policies on those websites and is not covered by this Policy. We encourage you to read the privacy statements of each and every website you visit or application you use. This Policy applies solely to information collected by us through the Services and does not apply to third party websites or applications. Payment Information: If you purchase a product or service through the Services, our third party payment processors will collect the billing and financial information they need to process your charges. This may include your postal address, email address and financial information. Blue Fever does not collect or store your financial information, like credit card numbers. However, Blue Fever’s third party payment processors may share non-financial information with us related to your purchases, like your name, shipping address and items purchased in order to fulfill your order.

Aggregate and/or De-Identified Information: We may aggregate or de-identify certain information that we collect from you. Aggregate and/or de-identified information is designed so that we cannot identify you personally.

WHAT IS YOUR POLICY REGARDING CHILDREN?
Blue Fever does not direct its Services to children under the age of thirteen (13) and does not knowingly collect information from such children.  We require all users of the Services to be at least thirteen (13) years old.  If we obtain actual knowledge that a user is under the age of thirteen (13), we will promptly delete all information associated with such account.  By using the Services, you are representing that you are at least thirteen (13) years old. 

MY CALIFORNIA RIGHTS.
California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their “personal information” (as defined under the California Online Privacy Protection Act), if any, for their direct marketing purposes in the prior calendar year, as well as the type of “personal information” disclosed to those parties. Blue Fever may limit the website’s availability, in whole or in part, concerning any person, geographic area or jurisdiction, at any time in its sole discretion.

The information we collect from you through your use of the Services is stored and processed in the United States in compliance with California and United States law. We may share your information with our group company affiliates, subsidiaries or joint ventures located outside of the United States.
